The operator of these pages takes the privacy of your personal data very seriously. We treat your personal data confidentially and according to the statutory data privacy regulations as well as this data privacy statement.

Various personal data are captured when you use this website. Personal data are data that can be used to determine your identity. This data privacy statement explains which data we collect and how we use them. It also explains how and for what purpose this is done.

We hereby point out that data transmission on the internet (e.g. during communication by e-mail) may have security loopholes. Guaranteed protection of data against access by third parties is not possible.

Note regarding the data controller

The controller for data processing on this website is:

Waldhausen GmbH & Co. KG
Von-Hünefeld-Str. 53
50829 Cologne
Germany

Phone: +49 221 58801 - 0
E-mail: anfrage@waldhausen.com

A data controller is a natural or legal person who decides, either alone or in conjunction with others, about the purposes and means for processing personal data (e.g. names, e-mail addresses etc.).

Revocation of your agreement to data processing

Many data processing steps are only possible with your explicit approval. You can revoke your previously provided approval at any time. An informal e-mail to us is sufficient. The legality of data processing before such a revocation is not affected.

The right to object to data collection in special cases and against direct advertising (Section 21 of the General Data Protection Regulations)

When data processing takes place based on Section 6 Par. 1 (e) or (f) of the General Data Protection Regulations, you are at any time entitled to object to the processing of your personal data for reasons resulting from your specific situation; this also applies to profiling based on these conditions. The respective legal basis on which the processing is based is described in this data privacy statement. If you file an objection, we will no longer process your personal data, except when we can provide evidence of compelling legitimate grounds for such processing that outweigh your interests, rights and liberties or if such processing helps in the enforcement, execution or defence of legal claims (objection according to Section 21 Par. 1 of the General Data Protection Regulations).

If your personal data are processed for direct advertising purposes, you are entitled to object at any time to the processing of your personal data for such purposes; this also applies to profiling in as far as it is used for direct advertising. Once you have objected, your personal data will no longer be used for direct advertising (objection according to Section 21 Par. 2 of the General Data Protection Regulations).

Right to complain to the competent supervisory authority

Persons affected by infringements of the General Data Protection Regulation have a right to complain to a supervisory authority, in particular in the member state in which they have their usual residence, their workplace or where the alleged infringement has taken place. The right to complain exists irrespective of other legal remedies provided by administrative law and the courts.

Right to data portability

You have the right to have any data that we automatically process based on your consent, or in the execution of a contract, handed over to you or to a third party in a common, machine-readable format. If you request direct transmission of the data to another controller, this will only take place if it is technically feasible.

SSL or TLS encryption

This website uses SSL or TLS encryption for security reasons and to protect the transmission of confidential information such as orders or enquiries that you send to us as the website operator. You can see that you are using an encrypted connection when the address bar of your browser changes from "http://" to "https://" and from the lock symbol in your browser bar.

Data that you send to us cannot be read by third parties when SSL or TLS encryption is activated.

Information, blocking, deletion and correction

Current legislation entitles you to obtain information about the storage of your personal data, their origin, the recipients and the purposes of data processing, as well as to enforce your right to correction, blocking or deletion of such data, at any time and at no cost to you. You can contact us at any time at the address provided in the "About Us" section to get more information about this topic or about personal data in general.

Right to restriction of processing

You are entitled to demand restrictions on the processing of your personal data. You can contact us at any time at the address provided in the "About Us" section. The right to restriction of processing applies in the following cases:

  • If you dispute the accuracy of your data stored with us, we will usually require time to check this. You are furthermore entitled to demand restrictions on the processing of your personal data for the duration of the investigation.
  • If your personal data were/are illegally processed, you can demand restriction of data processing instead of deletion.
  • If you no longer require your personal data, but want to use them to exercise, defend or enforce legal claims, you are entitled to demand restriction of processing of your personal data instead of deletion.
  • If you have filed an objection according to Section 21 Par. 1 of the General Data Protection Regulation, your and our interests must be weighed up. You are entitled to demand restrictions on the processing of your personal data as long as it has not been decided whose interests take precedence.

If you have restricted the processing of your personal data, these data may only be processed – apart from their storage – with your approval or to enforce, exercise, defend or protect the rights of another natural or legal person or to safeguard an essential public interest of the European Union or one of its member states.

Objection to advertising e-mails

Where contact data are published as part of the obligation to provide a legal notice, they may not be used to forward advertising and information materials which are not specifically requested. The operators of the website hereby explicitly reserve the right to take legal steps in the event of unsolicited mailing of advertising information, e.g. in the form of spam e-mails.

4. Data capture on our website

Cookies

Some pages on the website make use of so-called "cookies". Cookies do not cause damage to your computer and do not contain viruses. Cookies are used to make our services more user-friendly, effective and safe. Cookies are small text files that are stored on your computer by your browser.

Most of the cookies used by us are "session cookies". They are automatically deleted at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies allow us to recognise your browser at your next visit.

You can set your browser so that you will be informed when cookies are used and allow cookies only in specific cases, so that the acceptance of cookies is excluded for specific cases or in general and so that the automatic deletion of cookies is activated when you close the browser. Deactivation of cookies may reduce the functionality of this website.

Cookies that are required for performing the electronic communication process or for the provision of specific functions that you might require (e.g. shopping basket function) are stored according to Section 6 Par. 1 (f) of the General Data Protection Regulation. The website operator has a legitimate interest in the storage of cookies for the technically faultless and optimal provision of its services. Where other cookies are stored (e.g. cookies for the analysis of your browsing behaviour), they will be treated separately in these data privacy regulations.

Server log files

The provider of the website automatically collects and stores information in server log files that your browser automatically sends to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server enquiry
  • IP address

These data are not combined with other data sources.

These data are collected according to Section 6 Par. 1 (f) of the General Data Protection Regulation. The website operator has a legitimate interest in the technically faultless and optimised presentation of its website – which requires the compilation of server log files.

Contact form

If you send us enquiries via a contact form, the information in the form, including the contact data provided by you, will be stored by us for processing the enquiry and in the event of follow-up enquiries. We will not forward these data without your permission.

Processing of the data you have entered in the contact form will only take place on the basis of your consent (Section 6 Par. 1 (a) of the General Data Protection Regulation). You can revoke a previously provided consent at any time. An informal e-mail to us is sufficient. The legality of data processing performed prior to the revocation is not affected by the revocation.

The data entered by you in the contact form will remain with us until you request their deletion or revoke your permission to store them, or the purpose for storing these data no longer applies (e.g. after processing of your enquiry has been completed). This is notwithstanding any mandatory legal provisions, especially archiving periods.

Registration on this website

As a business customer (dealer), you can register on our website in order to make use of additional functions of the site. The data you enter will only be used by us for the purposes of providing the relevant offer or service for which you have registered. All mandatory information requested during registration must be entered in full, or your registration will be rejected.

In the event of significant changes, for example to the scope of our offer or in the event of technically essential changes, we will make use of the e-mail address you provided at the time of registration to keep you informed.

Processing of the data you entered at the time of registration will only take place on the basis of your consent (Section 6 Par. 1 (a) of the GDPR). You can revoke the consent you have given at any time. An informal e-mail to us is sufficient. This will not affect the legality of any data processing that has already been carried out.

The data recorded by us at the time of registration will be stored by us for as long as you are registered on our website and will subsequently be deleted. This will not affect any statutory storage periods.

5. Analysis tools and advertising

Google Analytics

This website makes use of the functions of the web analysis service Google Analytics. The service provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics makes use of so-called "cookies". These are text files stored on your computer that will allow your use of the website to be analysed. The information generated by the cookie regarding your use of this website will usually be forwarded to a Google server in the USA and stored there.

The storage of Google Analytics cookies and the use of this analysis tool take place on the basis of Section 6 Par. 1 (f) of the GDPR. The website operator has a legitimate interest in the analysis of the user behaviour to optimise both its online services and its advertising.

IP anonymisation

We have activated the IP anonymisation function on this website. This means that your IP address will be abbreviated by Google within member states of the European Union or in other states that are party to the Agreement on the European Economic Area before being forwarded to the United States. Only in exceptional cases will the full IP address be transmitted to a Google server in the United States and abbreviated there. At the request of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports about website activities and to render other services associated with website and internet use to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be combined with other Google data.

Browser plugin

You can prevent the storage of cookies by activating a corresponding setting of your browser software, but please note that in this case you may not be able to make use of all the functions of this website to their full extent. Moreover, you can prevent the data generated by the cookie and related to your use of the website (including your IP address) from being recorded by Google, as well as the processing of these data by Google, by downloading and installing the browser plugin available under the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

Objection to data recording

You can prevent Google Analytics from recording your data by clicking on the following link. An opt-out cookie will be placed to prevent your data from being recorded when you make future visits to this website: Deactivate Google Analytics.

More information about the use of user data at Google Analytics may be found in the Google data privacy statement: https://support.google.com/analytics/answer/6004245?hl=en-gb.

Processing on behalf of the controller

We have concluded a contract with Google as a processor and fully implement the strict conditions of the German data privacy authorities when using Google Analytics.

6. Newsletter

Newsletter data

If you wish to subscribe to the newsletter offered on the website, we will require your e-mail address as well as information that will allow us to verify that you are the owner of the e-mail address you have provided and that you agree to receive the newsletter. No additional data will be collected, except on a voluntary basis. We will only use these data to send you the information you requested and will not pass them on to third parties.

Processing of the data you have entered in the newsletter subscription form will only take place on the basis of your consent (Section 6 Par. 1 (a) of the GDPR). You may revoke the consent you have given to store the data, your e-mail address and its use to forward the newsletter at any time, for example via the "Unsubscribe" link in the newsletter. This will not affect the legality of any data-processing operations that have already been carried out.

The data you have provided us with for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter, and deleted once you have unsubscribed. Any data stored by us for other purposes will not be affected.

7. Plugins and tools

YouTube with privacy-enhanced mode

Our website makes use of plug-ins of the YouTube website. The operator of this site is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

We use YouTube in privacy-enhanced mode. According to YouTube, this mode means that YouTube will not store any information about visitors to this website before they view the video. However, privacy-enhanced mode does not entirely exclude the possibility that data may be forwarded to YouTube partners. Thus, YouTube will establish a connection to the Google DoubleClick network irrespective of whether you view a video.

As soon as you start a YouTube video on our website, a connection is established to the YouTube servers. The YouTube server is informed about which of our pages you visited. If you are logged into your YouTube account, you enable YouTube to connect your browsing behaviour directly to your profile. You can prevent this by logging out of your YouTube account.

After starting the video, YouTube can also place various cookies onto your device. With the aid of these cookies, YouTube can receive information about visitors to our website. Among other things, this information is used to record video statistics, to improve user-friendliness and to prevent attempted fraud. The cookies will remain on your device until you delete them.

Additional data-processing operations may be triggered after the start of a YouTube video, over which we have no influence.

The use of YouTube takes place in the interests of an attractive presentation of our online offers. This constitutes a justified interest in terms of Section 6 Par. 1 (f) of the GDPR (General Data Protection Regulation).

You may find further information about data privacy at YouTube in their data privacy statement at: https://policies.google.com/privacy?hl=en.

Google Maps

This website makes use of the map service Google Maps via an API. The service provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

It is necessary to store your IP address in order to use the functions of Google Maps. This information is usually transmitted to a Google server in the United States and stored there. The provider of this website has no influence on this data transmission.

The use of Google Maps is in the interests of an attractive depiction of our online offers and to make the locations indicated on our website easy to find. This constitutes a justified interest in terms of Section 6 Par. 1 (f) of the GDPR (General Data Protection Regulation).

More information about handling user data may be found in the Google data privacy statement: https://policies.google.com/privacy?hl=en.

Our social media presence

Data processing by social networks

We maintain publicly accessible profiles in social networks. You will find a detailed list of the social networks we use below.

Social networks such as Facebook, Google+ etc. can usually comprehensively analyse your user behaviour if you visit their website or a website with integrated social media content (e.g. Like buttons or advertising banners). A visit to our social media presences will trigger numerous data privacy-related processing operations. These are as follows:

If you have logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. Your personal data may even be recorded if you are not logged in or have no account with the relevant social media portal. In this case such data recording may take place via cookies stored on your device or by recording your IP address.

With the aid of the data thus recorded, the operators of social media portals may generate user profiles detailing your preferences and interests. This may result in you being shown advertising related to your interests both within and outside the relevant social media presence. If you have an account with the relevant social network, such interest-related advertising may be shown on all devices on which you are or have been logged in.

Please also take into account that we cannot track all processing operations on the social media portals. Depending on the provider, additional processing operations may be carried out by the operators of social media portals. Details may be found in the conditions of use and data privacy regulations of the various social media portals.

Legal basis

Our social media profiles are designed to guarantee the most comprehensive online presence possible. This is a justified interest in terms of Section 6 Par. 1 (f) of the General Data Protection Regulation. The analysis processes initiated by the social networks may be on a different legal basis, which must be stated by the operators of the social networks (e.g. consent in terms of Section 6 Par. 1 (a) of the General Data Protection Regulation).

Controller and exercising of legal rights

If you visit one of our social media sites (e.g. Facebook), we – together with the operator of the social media platform – will be responsible for the data processing operations triggered during this visit. You can exercise your rights (information, correction, deletion, restriction of processing, data transferability and complaints) towards either us or the operator of the relevant social media portal (e.g. Facebook).

Please note that, despite our joint responsibility with the social media portal operators, we do not fully control the data-processing operations of the social media portals. To a large extent, our options depend on the corporate policy of the service provider in question.

Storage period

Any data directly recorded by us via the social media presence are deleted from our systems as soon as the purpose for their storage no longer applies, when you request us to delete them or when you revoke your consent to store them. Saved cookies will remain on your device until you delete them. This is notwithstanding any mandatory legal provisions, especially storage periods.

We have no influence on the storage period of your data stored by the operators of social networks for their own purposes. For further details, please obtain information directly from the operators of the social networks (e.g. from their data privacy statements, see below).
